Confirm whether you deliver packaged products to consumers in Italy, including from another Amazon storefront. Gather your company’s establishment country, whether the products reach private consumers in packaging, and whether you first make them available in Italy. Check the national role and the packaging system.

Article 218(1)(r)–(s) distinguishes producers — suppliers, manufacturers and importers of empty packaging — from users (utilizzatori), including importers of filled packaging and distributors. Article 221(1) makes producers and users responsible for packaging waste relating to their products, in proportion to packaging placed on the Italian market.

Take part in CONAI or an allowed alternative. Article 221(2)–(3) sets out the system routes. Check which route applies to your role and retain its participation evidence; CONAI is not the only route described by the source.

Establishment matters

Under PPWR Article 3(1)(15)(d), a foreign distance seller first making packaged products available in Italy directly to end users is a producer for that EU rule. A seller established in another EU Member State needs an Italian EPR authorised representative by written mandate (Article 45(3)).

Check the register for each destination country.

Regulation (EU) 2025/40 (PPWR) applies since 12 August 2026 (Article 71). Article 3(1)(15)(d) includes foreign distance sellers first making packaged products available directly to end users in another Member State within the producer definition.

Article 44 provides for producer registration in each Member State where packaging or packaged products are first made available. Member States have 18 months from the first implementing act to set up the register, so do not assume every Article 44 register is already operating. Check the national arrangements for each destination.

Under Article 45(4), online marketplaces must obtain the producer’s registration and registration number for the Member State where the consumer is located, plus a self-declaration that EPR obligations are met there, before allowing sales to those consumers. Confirm what Amazon asks for in your account.

Keep the Italian system participation and representative mandate available while checking the requested registration evidence. An unconfirmed register opening is not a confirmed Amazon submission path; check current Seller Central help for your situation.

  • Check the storefront, delivery country and packaging scheme named in the request.
  • Check which business entity, number or evidence Amazon asks you to supply.
  • Keep the request, your submission and Amazon’s resulting status as separate records.

Is CONAI the only packaging system route?

No. Article 221 provides for CONAI or an allowed alternative. Check the conditions for the route that fits your national role.

Why does the pilot send sellers established in Italy to expert review?

Italian Article 218 distinguishes producers of empty packaging from users, including importers of filled packaging and distributors. The pilot leaves that domestic role assessment for expert review.

Is Italy’s PPWR Article 44 register open?

Its opening is not confirmed in this source review. Check the current national arrangements; the checklist asks you to register when it is open.

Does Italy require a representative from a seller outside the EU?

Italy’s rule for third-country sellers is not confirmed here. PPWR Article 45(3) allows Member States to require one; have Italy’s position reviewed for your case.
