Packaging EPR for Amazon sellers delivering to Spain

Amazon.es is a storefront. Spain is the destination.

Confirm whether you deliver packaged products to consumers in Spain, including from another Amazon storefront. Gather your company’s establishment country, whether the products reach private consumers in packaging, and whether you first make them available in Spain. Those are the questions behind the ComplyShelf packaging check.

Register with scheme evidence, then use the number.

  • Register in the packaging section of the Registro de Productores de Productos. Producers or their representatives provide a certificate of membership in an individual or collective EPR scheme; SCRAP is the collective route (Article 15(1)–(2)).
  • Put the assigned number on invoices and accompanying documents. Article 15(3) requires it on documents accompanying packaged products down to the point of sale.
  • Check the producer’s registration when distributing products. Retailers and distributors, including distance sellers, may only sell packaged products from producers with a registry number (Articles 30(a) and 37(a)).
  • Keep collection and treatment scheme evidence. Article 17(3) provides for individual or collective EPR schemes.

Establishment matters

Check the Spanish representative requirement.

Producers established in another EU Member State or a third country that sell products in Spain must designate an authorised representative in Spain (Article 17(2)). Keep the mandate with the Spanish packaging records.

Article 17(2) makes the first distributor established in Spain subsidiarily responsible where no representative has been designated. For packaged products from outside Spain sold through an e-commerce platform without a Spanish representative, the preamble and Article 2 describe the platform acting as producer for financial and reporting obligations. Check how that provision applies to the arrangement; it does not replace the stated duty to designate a representative.

Prepare annual data before 31 March.

Article 16(1)–(2) requires registered producers to report the Annex IV data for each calendar year before 31 March of the following year. Reporting is simplified for less than 15 tonnes per year; that is a simplified reporting route, not an exemption from registration.

PPWR Article 44(7) also provides for annual data by 1 June for the preceding year. Confirm how national register arrangements and PPWR reporting interact; do not treat the EU date as replacing Spain’s March deadline.

Check the register for each destination country.

Regulation (EU) 2025/40 (PPWR) applies since 12 August 2026 (Article 71). Article 3(1)(15)(d) includes foreign distance sellers first making packaged products available directly to end users in another Member State within the producer definition.

Article 44 provides for producer registration in each Member State where packaging or packaged products are first made available. Member States have 18 months from the first implementing act to set up the register, so do not assume every Article 44 register is already operating. Check the national arrangements for each destination.

Under Article 45(4), online marketplaces must obtain the producer’s registration and registration number for the Member State where the consumer is located, plus a self-declaration that EPR obligations are met there, before allowing sales to those consumers. Confirm what Amazon asks for in your account.

Spain’s provisions about platforms without a Spanish representative do not confirm what Amazon will request or do for your account. Keep the registry confirmation, scheme evidence and mandate available while checking Seller Central.

  • Check the storefront, delivery country and packaging scheme named in the request.
  • Check which business entity, number or evidence Amazon asks you to supply.
  • Keep the request, your submission and Amazon’s resulting status as separate records.
